Brussels Autumn 2015


QUO VATIS. The VAT System - Today? And where to in the Future?

Some of the topics which were presented at the conference are: Where is VAT heading in the next 5 years? (update from the EC and Tax Authorities), EU differences with respect to recoverability of input VAT and compliance, VAT fraud, EU case law - Technical update, and many more.

Among others we had as guest speakers Donato Raponi from the European Commission, Piet Battiau from OECD, representatives from the Belgian, Portuguese Tax Administration. We  also had Mr Karl-Heinz Haydl, the Global VAT/GST Leader Technical & Policy from GE Corporate, who presented Quo VATis from a Business perspective.

Quo VATis – National Administrations’ views - Belgian Tax Administration

Agnès Walckiers is a VAT expert in international cooperation for the Belgian Federal Public Service Finances (FPS Finances).

She is the project manager for the implementation of the Mini One Stop Shop (MOSS) in Belgium. She has followed all European workshops defining the functional and technical requirements for the MOSS.

Agnès Walckiers is also the Belgian national expert for the European standing committee on administrative cooperation for VAT matters. She speaks French and English.

Latest News from EU - New Italian rules, split payments and electronic invoicing

Alessandro Garzon is a Chartered accountant. Founder and partner of T.B.S Tax Back Service Srl. He is a member of the IVA since 1995 with his company T.B.S, founded in 1988. Ever since the beginning T.B.S takes care of VAT technical issues related to the field of transport. As from 1992 the VAT assistance has been enlarged to several other sectors (cars, pharmaceuticals, fashion, event arrangements, fertilizers, distance sales, catering, electronics, and so on). T.B.S. currently also carries out both VAT representation and VAT direct identification services.

Alessandro Garzon is a frequent speaker at seminars dealing with Italian VAT issues. He is the Chairman of Studio Garzon, which provides professional advice in the area of indirect taxation; technical assistance is mainly related to VAT issues referred to cross-border transactions and to public bodies.

Worldwide VAT/GST Update - VAT Update from Iceland

Bjarnfredur has extensive experience in tax law, corporate finance, mergers and acquisitions and corporate restructuring.

He has written various articles and papers on foreign and domestic business law. He is the main author of the Icelandic Handbook on Value Added Tax, issued by the Inland Revenue in 1996 and still in use.

Bjarnfredur holds an LL.M. degree from the University of Miami and is a member of the Icelandic Bar Association. He has served as an independent director on the board of various companies, e.g. large companies in the area of production and finance.

In such capacity she advises major Financial, Real Estate, Health, Telecommunications & Information Technology groups and corporations mainly on indirect tax issues, focusing on VAT and custom matters. Within these fields, she has actively assisted clients in redefining and implementing procedures and structures in order to achieve tax optimization and has been leading lawyer in several winning and breakthrough cases against the Tax Authorities. Daniel currently heads the International Indirect Tax Services Team at RSM Hungary, the leading fiscal representative service provider in Hungary. Daniel has 10+ years of experience in indirect tax , including 5+ years of experience as Deloitte manager in the EU and Asia Pacific region. Trained as a lawyer at ELTE University he acquired tax professional qualification and is registered as tax professional with the Hungarian Ministry of National Economy. During his career, Daniel managed teams of tax professionals in multiple projects/tasks/roles and coordinated regional indirect tax (GST and VAT) advisory projects in Europe and Asia Pacific – dealt with tax professionals from over 30 jurisdictions across 5 continents. Mr. Donato Raponi joined the European Commission in 1980 and is currently Head of the VAT Unit. He worked in the Budget, Internal Market and Taxation Directorates. 

In the area of taxation policy he served in different posts, e.g. administrator, assistant to the Director, Deputy Head of the VAT Unit, Head of the Unit dealing with excise duties, environment, transport and energy duties and Head of tax administration and anti fiscal fraud Unit. 

Mr. Raponi holds a Masters degree in European Tax Law and a Bachelor in Economics. He is Co-Author of the book “Arriva l’euro” (Carmenta Editor) and several articles in tax matters. He is professor of European Tax Law at Ecole supérieure des sciences fiscales, Brussels, Belgium.

Emmanuel is a French tax lawyer specializing exclusively in indirect taxes (VAT, Excise and Customs duties). VAT automation – a corporate perspective

Fred L.J. Vervaet worked in the international VAT practice of Arthur Andersen and PricewaterhouseCoopers in Rotterdam. He has been working for Imation Europe BV where he was responsible for indirect taxes in Europe and for Lucent Technologies, where he was globally responsible for Value Added Taxes and similar taxes. He was a partner of “the VAT Consultancy Firm” and since September 2011, Fred Vervaet is the Global Head of Indirect Tax for LyondellBasell and responsible for indirect taxes worldwide.

Fred Vervaet has published many articles on value added tax in specialist magazines. He is also the co-author of the books “Veredelingsverkeer” (Kluwer/Fenedex), “Een fiscale procedure omzetbelasting” (outlining the rules with regard to the litigation in Dutch tax courts and the European Court of Justice) and “BTW en Internationaal zakendoen”. Fred Vervaet also acts as a lecturer on seminars and courses in relation to VAT.

Karl-Heinz Haydl, General Electric Company (GE) - is a VAT practitioner who started his journey in VAT in the German tax authorities where he worked for 3 years, followed by a 4 years´ stopover in a big 4 firm dealing with international VAT aspects before he joined GE 17 years ago, where he is now the Leader of GE´s European Corporate VAT Team and the Global VAT/GST Technical & Policy Leader actively involved in various industry groups on an EU, Member State and global level, i.e. as chair of the joint BIAC VAT/GST Task Force and of the BIAC business group to the OECD TAG on VAT/GST.

Technical VAT Update - VAT cases from Belgian Courts and Tribunals in reference to EU law and CJEU

Strong with an experience of 22 years, holding a Master in Tax Law and passionate in VAT, Katia founded in January 2011 her own consultancy company OmniVAT Consulting in Brussels. Her VAT carrier began in the year 1993 and up to 2001, she developed her experience in VAT in some 'Big 4' consultancy companies where she could experience some international projects on VAT but also on customs matters. From 2001 to 2010, Katia worked for the 'VAT House' where she began to give seminars on Belgian and European VAT topics. She is also specialized in Incoterms and she is the author of two books : Le Remboursement de la TVA au sein de l’Union européenne et le Vademeccum de la facturation. Katia regularly gives trainings, seminars and workshops in the VAT field sometimes combined with customs matters and with Incoterms for different specialized companies or Chambers of Commerce.

Marja van den Oetelaar has a university degree in tax law. After working for several years as a VAT specialist in two of the BIG4 firms, she started her own company, The Vat Consultancy Firm, at Naarden in the Netherlands. Since 2002, The VAT Consultancy Firm has been advising internationally operating companies on VAT issues. On behalf of several tax institutions, she lectures on VAT. She has also published several books and articles on VAT.

Quo VATis – National Administrations’ views - Portuguese Tax Administration

Miguel Pinto is the Deputy Director-General responsible for VAT policy in the Portuguese Tax and Customs Authority since late 2011. Representing his organisation, he is a member of the EU VAT Forum and the OECD VAT Global Forum. He is also correspondent of the CIAT (Inter-American Center of Tax Administrations). Previously, he was tax counsellor in the Portuguese Permanent Representation close to the EU and before that he worked in the VAT Unit of the European Commission/ DG Taxud. Miguel holds a Master Degree in European Integration and Development and a Law Degree. He is a lecturer and an author of books and articles on taxation and VAT in particular.

Nadia Van Puymbrouck has obtained her degree in tax law and fiscal sciences at the university of Antwerp and Leuven. In addition to this she has obtained the European VAT expert degree at VAT Forum. After a two-year period working in Senegal she returned to Belgium and started her professional journey at Shell, working as an indirect Tax Advisor. She continued her career with Yara where she is working as a Senior VAT Manager. She is responsible for the indirect taxes of Yara in the EU. She is also managing the VAT processes within Yara, including automation of processes. In her role, she is also responsible for creating VAT awareness within Yara and she provides many trainings and workshops within Yara.

OECD update – International VAT/GST Guidelines

Piet Battiau, a Belgian national, is the Head of the Consumption Taxes Unit in the Centre for Tax Policy and Administration (CTPA) at the OECD. The Consumption Taxes Unit is responsible for the OECD’s expanding work on consumption taxes. Its main priority is the development of International VAT/GST Guidelines as an international standard for the application of VAT/GST to international trade. The Consumption Taxes Unit also supports work on other consumption tax matters, including the economic impact assessment of VAT-policies, supporting governments in developing and implementing efficient VAT-systems and sharing knowledge to help countries reduce the incidence of VAT abuse. A major initiative was the creation of the OECD Global Forum on VAT as a unique platform for a global dialogue on VAT policy and on international standards for the design and operation of VAT systems.

Technical VAT Update - EU Case Law

Dr. Stefan Maunz advises clients on all VAT matters and represents them in dealings with the tax authorities and before the tax courts, the German Federal Finance Court and the European Court of Justice. The majority of his clients consist of larger medium sized businesses, German corporate groups and foreign companies of all sizes. He regularly lectures on VAT topics at both the domestic and international level. A further important focus is advising on customs issues, in particular, those connected with import VAT.

Dr. Stefan Maunz is a visiting lecturer at the University of Munich and a member of various national and international VAT research groups and VAT clubs as well as a partner of VAT Forum C.V. Stephen Dale is a partner in the Indirect Tax group and compliance services in Landwell and has worked in French taxation for more than twenty years, having previously worked with PricewaterhouseCoopers in the UK.

Stephen is a member (and former Chairman) of the FEE (Fédération des Experts Comptables Européens) indirect tax working party and a  member of the Institute of Chartered Accountants in England and Wales VAT Committee (and former Chairman). He represents the IVA on the EU VAT Forum and is a member of the OECD’s  Global VAT Forum.

He is a board member of the Association de la Pratique de la TVA européenne (APTE).

Stephen is also President of the International VAT Association. He is the author of several publications like VAT Yearbook – Kluwer, VAT Guides – PwC, Articles – International Indirect Tax, BNA, journals and newspapers.
